Motor Vehicle Dealer Licensing

The licensing of motor vehicle dealers in the Cook Islands is governed by the Motor Vehicle Dealers Act 1986. The Act requires that any person or company engaged in the business of buying, selling, or exchanging motor vehicles must hold a valid dealer licence. Licensing ensures that all motor vehicle trading is carried out lawfully, transparently, and in the best interests of consumers and the community.

Licensing Authority

The Registrar of Licensed Motor Vehicle Dealers, appointed under the Act, is responsible for administering and enforcing the licensing system. The Land Transport Division of the Ministry of Transport supports the Registrar by processing applications, maintaining records, and ensuring compliance with statutory requirements.

Eligibility

To be considered for a dealer licence, applicants must:

  • Be a natural person or a registered company in the Cook Islands.
  • Demonstrate good character and financial responsibility.
  • Not be disqualified under Sections 53 or 54 of the Act.
  • Operate from a suitable place of business.

Application Process

  1. Submission – A written application must be lodged with the Ministry of Transport, together with the prescribed fee.
  2. Public Notice – Applicants are required to publish notice of their application in a local newspaper, as provided for in the Act, allowing the public the opportunity to raise any objections.
  3. Assessment – The Registrar will review the application, including any public objections, and may request further information if necessary.
  4. Decision – A licence may be granted or declined in accordance with the provisions of the Act.

Licence Renewal

Dealer licences are issued for a fixed period and must be renewed prior to expiry. Renewal applications are subject to the same requirements of compliance, suitability, and payment of prescribed fees.
